Daniel Berger represents businesses on commercial matters, primarily in litigation and pre-litigation disputes. His practice routinely involves litigating complex commercial lawsuits in state and federal courts in the Commonwealth of Virginia. However, he also advises companies on corporate matters, ranging from transactional work to risk assessment and mitigation. Daniel’s primary goal is always to guide his clients on how to best protect and grow their businesses while minimizing the impact to their operations.
Daniel has a wealth of experience with the routine legal issues businesses face. As a litigator, he understands the key risks associated with transactions that are most likely to lead to disputes down the road. When disputes arise, Daniel has extensive experience in the courtroom and is willing to fight for his clients through trial, if necessary. Nevertheless, Daniel emphasizes the value of preventative measures to mitigate those risks when advising clients in transactions and always looks for practical resolutions if disputes occur.
Daniel’s typical cases involve a wide range of issues that businesses routinely face including contract breaches, commercial lease disputes, collections, professional liability, unfair competition, trade secret misappropriation, and other business torts. He also has valuable experience guiding business owners and investors through intra-corporate disputes and business divorces.
Before going into private practice, Daniel served as Judicial Clerk to Hon. Robert J. Humphreys, Court of Appeals of Virginia, 2011-2013.
- Obtained dismissal of all claims against former directors of a condominium association in a suit brought by the company alleging misconduct. Judgment upheld on appeal to the Virginia Supreme Court and obtained an award of all attorneys’ fees and costs for the former directors.
- Obtained dismissal of all claims against a landlord made by a commercial tenant over a signage dispute.
- Represented a bank in multiple litigated matters in various courts relating to nonperforming assets purchased by the bank from a failed financial institution through the FDIC.
- Represented a bank in litigation alleging fraud and challenging the bank’s security interest in real property collateral.
- Advised and represented a court-appointed receiver in connection with the liquidation of real property assets spanning multiple states.
- Represented a business in litigation against a former employee and the employee’s new company alleging misappropriation of trade secrets and trademark infringement.
